  5.                  1/2 FAST SOFTWARE PRODUCTS LICENSE AGREEMENT

  7. The program(s) on the enclosed disk(s) is(are) licensed to the user.  By
  8. reading this file, you indicate your acceptance of the 1/2 Fast Software
  9. Products License Agreement.

  11. This legal agreement is between you, the end user, and 1/2 Fast Software
  12. Products Division of CAVE, Inc.  (hereinafter known as 1/2 FAST SOFTWARE).
  13. BY READING THIS FILE AND PRESSING ANY KEY OTHER THAN "^C" (Control-C), YOU
  14. ARE AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT, WHICH INCLUDES
  15. THE SOFTWARE LICENSE, SOFTWARE DISCLAIMER OF WARRANTY, AND HARDWARE LIMITED
  16. WARRANTY (collectively the "Agreement").

  18. THIS AGREEMENT CONSTITUTES THE COMPLETE AGREEMENT BETWEEN YOU AND 1/2 FAST
  19. SOFTWARE.  IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT RUN THIS
  20. SOFTWARE.  PROMPTLY CUT THIS DISK IN 1/2 AND RETURN THIS DISK PACKAGE AND THE
  21. OTHER ITEMS (INCLUDING WRITTEN MATERIALS, BINDERS OR OTHER CONTAINERS, AND
  22. HARDWARE, IF ANY) THAT ARE PART OF THIS PRODUCT, TO THE PLACE WHERE YOU
  23. OBTAINED THEM FOR A FULL REFUND.

  25.                        1/2 FAST SOFTWARE SOFTWARE LICENSE
  26.  
  27. 1.  GRANT OF LICENSE.  in consideration of payment of the LICENSE fee, which is
  28. part of the price you paid for this product.  1/2 FAST SOFTWARE, as Licensor,
  29. grants to you, the Licensee, a nonexclusive right to use and display this copy
  30. of a 1/2 FAST SOFTWARE program (hereinafter the "SOFTWARE") on a single
  31. computer (i.e.  with a single CPU) at a single location.  If the single
  32. computer on which you use the SOFTWARE is a multiuser system, the License
  33. covers all users on that system.  1/2 FAST SOFTWARE reserves all rights not
  34. expressly granted to LICENSEE.

  36. 2.  OWNERSHIP OF SOFTWARE.  As the LICENSEE, you own the magnetic or other
  37. physical media onto which the software is originally or subsequently recorded
  38. or fixed, but 1/2 FAST SOFTWARE retains right, title, and ownership of the
  39. SOFTWARE recorded on the original disk copy(ies) and all subsequent copies of
  40. the SOFTWARE, regardless of the form or media in or on which the original and
  41. other copies may exist.  This License is not a sale of the original SOFTWARE
  42. nor of any copy.

  44. 3.  COPY RESTRICTIONS.  This SOFTWARE and the accompanying written materials
  45. are copyrighted.  Unauthorized copying of the SOFTWARE, including SOFTWARE that
  46. has been modified, merged, or included with other software, or of the written
  47. materials is expressly encouraged.  You may be held legally responsible for any
  48. copyright infringement that is caused or encouraged by your failure to abide by
  49. the terms of this License.  Subject to these restrictions, and if the SOFTWARE
  50. is not copy protected, you may make one (1) copy of the SOFTWARE solely for
  51. backup purposes.  You must reproduce and include the copyright notice on the
  52. backup.  Then back up your backup, and make a few copies for your friends.

  54. 4.  USER RESTRICTIONS.  As the LICENSEE, you may physically transfer the
  55. SOFTWARE from one computer to another.  You may electronically transfer the
  56. SOFTWARE from one computer to another over a network.  You may distribute
  57. copies of the SOFTWARE or accompanying written materials to others.  You may
  58. modify, adapt, translate, reverse engineer, decompile, disassemble, or create
  59. derivative works based on the SOFTWARE.  You may modify, adapt, translate, or
  60. create derivative works based on the written materials without the written
  61. consent of 1/2 FAST SOFTWARE.  I would appreciate a copy if you make
  62. significant changes.

  64. 5.  TRANSFER RESTRICTIONS.  This SOFTWARE is licensed only to you, the
  65. LICENSEE, and may be transferred to anyone without the prior written consent of
  66. 1/2 FAST SOFTWARE.  Any transferee of the SOFTWARE shall be bound by the terms
  67. and conditions of this Agreement.  In no event may you transfer, assign, rent,
  68. lease, sell, or otherwise dispose of the SOFTWARE on a temporary basis except
  69. as expressly provided herein.  Give them their own permanent copies.
  70.  
  71. 6.  TERMINATION.  This License is effective until terminated.  This License
  72. will terminate automatically without notice from 1/2 FAST SOFTWARE if you fail
  73. to comply with any provision of this License.  Upon termination you must
  74. destroy the written material and all copies of the SOFTWARE, including modified
  75. copies, if any.
  76.  
  77. 7.  UPDATE POLICY.  1/2 FAST SOFTWARE may create, from time to time, updated
  78. versions of this SOFTWARE.  At its option, 1/2 FAST SOFTWARE may make such
  79. updates available to the LICENSEE and transferees who have paid the update fee
  80. and returned the Registration Fee to 1/2 FAST SOFTWARE.

  82. 8.  RUNTIME ROYALTY.  A runtime royalty of $100 is assessed for each use.
  83. Please place one (1) one hundred dollar Federal Reserve Note ($100.00), face
  84. up, left edge first, into drive $:, and press the "RESET" button after each
  85. use.
  86.  
  87. 9.  MISCELLANEOUS.  This Agreement is governed by the Laws of the State of
  88. Confusion.

  90.                   DISCLAIMER OF WARRANTY AND LIMITED WARRANTY
  91.  
  92. THE SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS (INCLUDING INSTRUCTIONS FOR
  93. USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.  FURTHER, 1/2 FAST
  94. SOFTWARE DOES NOT WARRANT, GUARANTEE, NOR MAKE ANY REPRESENTATIONS REGARDING
  95. THE USE, OR THE RESULTS OF THE USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN
  96. TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE.  THE
  97. ENTIRE RISK AS TO THE RESULTS, AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY
  98. YOU.  IF THE SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE YOU, AND NOT 1/2 FAST
  99. SOFTWARE OR ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES, ASSUME THE ENTIRE
  100. COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

  102. 1/2 FAST SOFTWARE warrants to the original LICENSEE that (a) the disk(s) which
  103. the SOFTWARE is recorded is(are) free from defects in materials and workmanship
  104. under normal use and service for a period of ninety (90) days from the date of
  105. delivery as evidenced by a copy of the receipt, and (b) the hardware
  106. accompanying the SOFTWARE is free from defects in materials and workmanship
  107. under normal use and service for a period of one (1) year from the date of
  108. delivery as evidenced by a copy of the receipt.  Further, 1/2 FAST SOFTWARE
  109. hereby limits the duration of a implied warranty(ies) on the disk(s) or such
  110. hardware to the respective periods stated above.  Some states do not allow
  111. limitations on duration of an implied warranty, so the above limitation may not
  112. apply to you.  Should you reside in one of such progressive states, you must
  113. immediately destroy any written materials and destroy by cutting in half, all
  114. copies of this SOFTWARE, including modified copies, if any.
  115.  
  116. 1/2 FAST SOFTWARE's entire liability and your exclusive remedy as to the
  117. disk(s) or hardware shall be, at 1/2 FAST SOFTWARE's option, either (a) return
  118. of the purchase price or (b) replacement of the disk or hardware that does not
  119. meet 1/2 FAST SOFTWARE's Limited Warranty and which is returned to 1/2 FAST
  120. SOFTWARE with a copy of the receipt.  If failure of the disk or hardware has
  121. resulted from accident, abuse, or misapplication, 1/2 FAST SOFTWARE shall have
  122. no responsibility to replace the disk or hardware nor to refund the purchase
  123. price.  Any replacement disk or hardware will be warranted for the remainder of
  124. the original warranty period or thirty (30) days, whichever is longer.

  126. THE ABOVE ARE THE ONLY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
  127. INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
  128. FITNESS FOR A PARTICULAR PURPOSE, THAT ARE MADE BY 1/2 FAST SOFTWARE ON THIS
  129. 1/2 FAST SOFTWARE PRODUCT.  NO ORAL OR WRITTEN INFORMATION NOR ADVICE GIVEN BY
  130. 1/2 FAST SOFTWARE, ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE
  131. A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY, AND YOU MAY NOT
  132. RELY ON ANY SUCH INFORMATION OR ADVICE.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL
  133. RIGHTS, YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

  135. NEITHER 1/2 FAST SOFTWARE NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE
  136. CREATION, PRODUCTION, OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY
  137. DIRECT, INDIRECT, CONSEQUENTIAL, INCONSEQUENTIAL, OR INCIDENTAL DAMAGES
  138. (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF POTENTIAL BUSINESS
  139. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF SANITY,
  140. AND THE LIKE) ARISING OUT OF THE USE OR ABUSE OF OR INABILITY TO USE SUCH
  141. PRODUCT EVEN IF 1/2 FAST SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  142. DAMAGES.  BECAUSE SOME POLITICAL ENTITIES DO NOT ALLOW THE EXCLUSION OR
  143. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE
  144. LIMITATION MAY NOT APPLY TO YOU.  SHOULD YOU RESIDE IN SUCH A PATERNAL SOCIAL
  145. POLITICAL ENTITY, THEN YOU MUST IMMEDIATELY DESTROY ALL WRITTEN AND PRINTED
  146. MATERIALS AND DESTROY BY CUTTING IN HALF ALL COPIES OF THIS SOFTWARE, INCLUDING
  147. MODIFIED COPIES, IF ANY.

  149. This disclaimer of Warranty and Limited Warranty is governed by the Laws of the
  150. State of Consternation.

  152.                        U.S.  GOVERNMENT RIGHTS RESTRICTED
  153.  
  154. This SOFTWARE and documentation are provided with RESTRICTED RIGHTS.  Use,
  155. duplication, or disclosure by the Government of The United States of America,
  156. or by any of its political subdivisions, is expressly forbidden.
  157.  
  158. Should you have any questions regarding this Agreement, please contact in

  161. Should this warranty look somewhat familiar, you should read again the
  162. Microsoft warranty which came with your DOS, from which this warranty was
  163. hastily plagiarized.
  164.  
  165. Dr. Krypton will encrypt and decrypt your file to the level of security chosen
  166. by you.  No record is kept of your personal encryption numbers.  Security
  167. breaches may occur if you write your numbers on paper to remember them, or if
  168. you pick such obvious numbers as the charge on an electron or your birthdate.
  169. I guarantee that even the National Security Service cannot decrypt your files
  170. encrypted with ten pens.  Should your files be decrypted other than by use of
  171. Dr. Krypton or a similar algorithm, I will gladly refund your registration fee
  172. if you tell me how you did it.
